The platform can be used by:
Ship Owners (vessel owners or operators)

Other related parties who have been granted authorized access

To register, you need to:

Fill in your company information completely and accurately

Upload valid legal company documents

Provide an active email address to receive system notifications

The information you need to prepare includes:

Company name

Company address

Email and contact number

Type of company (Ship Owner / Cargo Owner)

Legal company documents (Business Registration Number, Trading License, Tax Identification Number, Deed of Establishment, Official Decree, etc.)

The verification process typically takes 1–4 business days, depending on the completeness and validity of the submitted information and documents.

Once approved:

The company account will be Active

The company can access the Ship IT dashboard

The company can proceed with vessel registration (for Ship Owners) or cargo planning (for Cargo Owners)

Some common reasons include:

Company information is incomplete or incorrect

Users are required to correct the information and/or documents according to the system’s notes, and then resubmit for verification.

Vessel Registration is the process of recording a vessel’s technical and legal information in the Ship IT system, enabling the vessel to be digitally managed and monitored.

The required information includes:

Vessel name

IMO number / vessel identification

Vessel type

Ship particulars

Vessel nationality (flag)

Yes. Ship Owners can register multiple vessels under a single company account.

The types of vessels that can be added include:

Dry bulk vessels (e.g., tugboats and barges, bulk carriers, etc.)

Liquid cargo vessels (e.g., oil tankers, CPO tankers, etc.)

Container vessels (e.g., ro-ro container vessels, feeder vessels, etc.)

General cargo vessels

Gas vessels

Specialized vessels

Document Company Preparation is the process of uploading and verifying a company’s legal documents as a prerequisite for full access to the Ship IT system.

The required documents include:

Deed of Establishment and/or Company Amendments

Business Registration Number (NIB)

Company Tax Identification Number (NPWP)

Trading License (SIUP/SIUPAL)

Official Decree (SK)

Relevant Business Licenses

File formats: PDF, JPG, JPEG, PNG

Maximum file size: 5 MB per file

Documents may be rejected if:

They are unclear or unreadable

They have expired

The data is inconsistent with the information in the system

Users are required to re-upload updated documents and ensure the data is accurate before resubmitting for verification.

Yes. All documents are stored securely and can only be accessed by authorized parties in accordance with Ship IT’s privacy policy.

Users can click “+Add Cargo Planning” on the main dashboard page of Ship IT and fill in the shipment details, such as POD, POL, laycan period, time departed, time arrived, and cargo details.

Users can choose available vessels based on schedule, type, and capacity that match their cargo, and then submit an order request to the Ship Owner.

The Cargo Owner can create a new “+Add Cargo Planning” and select another available vessel that meets the cargo requirements.

The Negotiation feature is a tool within the Ship IT platform that allows Ship Owners and Cargo Owners to transparently negotiate prices, charter terms, and vessel operational requirements, with all discussions properly documented.

Negotiations can be conducted by:

Ship Owners or their authorized company representatives

Cargo Owners or their authorized company representatives

Other parties granted authorization by the system

Negotiable aspects include:

Freight / Charter Rate

Laycan

Other operational terms as agreed upon by the parties

Currently, it is not saved. However, this will be considered for future updates so that negotiation history can be stored in the Ship IT system as an official reference and documentation.

The applicable agreement is a Contract of Carriage (Charter / Freight Agreement), which is formed when the Cargo Owner makes a booking and the Ship Owner accepts the order through the Ship-It platform.

No. Ship IT acts as an intermediary platform (marketplace) and is not a party to the contract of carriage between the Ship Owner and the Cargo Owner, unless expressly stated otherwise in writing.

The agreement is considered valid and binding when:

The Cargo Owner makes a booking;

The Ship Owner accepts the booking on the platform; and

Both parties have agreed to the terms and conditions displayed on the platform.

The Ship Owner is responsible for:

providing a vessel that meets the agreed specifications;

ensuring the safety and seaworthiness of the vessel;

carrying out the transportation of cargo from the port of loading to the port of discharge; and

complying with applicable maritime and shipping regulations.

The Cargo Owner is responsible for:

the accuracy of cargo information (type, weight, volume, and nature of the goods);

the legality of the cargo and all required cargo documentation;

ensuring the cargo is ready in accordance with the agreed schedule; and

payment of the transportation charges as agreed.

Transportation rates and charges are determined based on the type and volume of cargo, shipping route, type of vessel, voyage duration, and prevailing market conditions. In addition, the calculation also takes into account Customary Quick Despatch (CQD), which refers to loading and unloading time adjusted to local port practices, ensuring that the charges are more realistic and reflect actual operational efficiency.

Transportation charges are inclusive of applicable taxes, unless otherwise stated in the contract or agreement.

Yes. The Cargo Owner may recommend an agent during the agreement setup. The Ship Owner may accept or reject the recommended agent based on mutual agreement.

Changes or cancellations may only be made in accordance with:

the terms agreed upon at the time of booking; and

the current status of the transportation process.

Cancellation fees may apply as agreed.

In the event of a delay:

the Ship Owner is required to provide information and the reasons for the delay; and

claim settlement will follow the provisions set out in the agreement and applicable laws.

Responsibility for cargo damage or loss is governed by the agreement and depends on:

the cause of the incident;

insurance provisions (if any); and

supporting evidence and official reports submitted.

Yes. Users may update their mobile phone number in their profile, subject to prior approval by the platform administrator. Once approved, the user will be able to access the “process to sign” feature, and the e-signature link will be sent to the new WhatsApp number.

Shipment tracking is a feature that allows users to monitor the status and location of cargo shipments in real time or at regular intervals, from the loading process until discharge, through the Ship-It platform.

The Ship Owner is responsible for:

updating the vessel’s voyage status; and

providing shipment milestones.

Ship-It displays this information to the Cargo Owner through the platform.

Shipment tracking statuses generally include:

Arrival at POL

Departure

Sailing

Arrival

Discharge

Tracking is updated periodically at intervals of approximately 1–4 hours using an IoT (Internet of Things) Tracking Interface.

The Cargo Owner can:

access the Order Detail menu; and

view the shipment status, location, and voyage history.

If tracking indicates a delay:

the Ship Owner is required to provide clarification; and

further actions will follow the provisions in the agreement related to delays and claims.

A Voyage is a feature used to manage a vessel’s journey in a structured manner, from assignment and voyage execution to voyage completion.

Voyage data includes:

vessel information;

shipping route;

Port of Loading (POL) and Port of Discharging (POD);

ETA / ETD; and

vessel operational status.

Voyage data is entered by the Ship Owner or the vessel operator who has been granted authorized system access.

Yes. Voyage data is integrated with the Tracking, Documents, and Payment features to ensure a consistent and seamless operational workflow.

The Payment feature is a facility used to manage shipping transaction payments in an integrated and well-documented manner.

Payments that can be managed include:

Freight / Charter payments

Demurrage & Despatch

Operational costs as agreed

Payment verification status is updated automatically by the system when users make payments via Midtrans Virtual Account.

Yes. All payment history is stored in Ship IT and can be accessed as an archive and for audit purposes.

Please ensure that:

your email and password are correct;

your account has been verified; and

use the “Forgot Password” feature if needed.

This message indicates that the user does not have permission to access the selected feature or module, or that the login session has expired. Please log in again or contact the helpdesk.

Users are advised to:

ensure the file format and size comply with the requirements;

check the stability of the internet connection; and

re-upload the document.

Users should contact the Helpdesk if:

errors occur repeatedly;

data is not saved correctly;

system access is blocked without a clear explanation.

Users can submit complaints via:

To expedite the handling process, please include:

company name / user name;

active email and contact number;

order number / shipment ID;

a clear description of the complaint; and

supporting evidence (system screenshots, receipts, or related documents).

The Customer Service team will provide an initial response within 5 minutes after receiving the complaint.
The team will then coordinate with the relevant parties to address the issue within 24 hours.
If the complaint is not resolved within 24 hours, the Customer Service team will provide an update based on the complexity of the issue and dependency on other parties.

Users can track complaint status through:

the Ticket ID in Ship-It Help Center;

email updates from the Ship-It support team; and

updates via Ship-It official WhatsApp chat.

If a vessel arrives later than the agreed timeframe (outside of Force Majeure conditions), the Ship Owner will be subject to a daily delay penalty as compensation to the affected Cargo Owner.

In case of technical issues requiring vessel substitution, the replacement vessel must meet at least the same specifications or higher without additional cost to the Cargo Owner.

Repeated delays or failure to meet SLA standards may result in account rating reduction or suspension of access to the Ship Owner’s PRO/REGULAR subscription packages.

The Ship Owner is fully responsible for refunds of received payments in accordance with the applicable refund policy in the Ship-It App, as well as the cancellation penalty.
The penalty rate is based on the transaction value specified in the vessel booking feature on the Ship-It App.

If loading is delayed due to cargo unpreparedness, incomplete cargo documents, or administrative issues from the Cargo Owner, a demurrage (delay) fee will apply.
Daily penalty rates are based on the transaction value specified in the vessel booking feature on the Ship-It App.

Unilateral cancellation of cargo may be subject to cancellation fees according to the applicable commercial policy.

Ship-It offers several subscription options for Ship Owners:

New Registration Incentive Program: Exclusive benefit of Free Access for the first 1 to __ vessels registered in the App.

Company Registration: Free registration for company entry into the system; access is limited for system exploration purposes only.

REGULAR Package (IDR 12,000,000/Year/Vessel): Full access to receive cargo inquiries quickly and monitor assets via the dashboard during the shipping process.

PRO Package (IDR 30,000,000/Year/Vessel): Includes all features of the REGULAR package plus access to Fleet Management System (crew and permit monitoring according to regulations) and a discount on transaction commission percentage.

For each successfully completed shipment, partners receive a commission based on the total invoice value:

Invoice < IDR 1 Billion: 3.00%

Invoice IDR 1 – 1.5 Billion: 2.50%

Invoice > IDR 1.5 Billion: 2.00%

Commission rates depend on the subscription package chosen during vessel registration.

Yes, Ship-It supports multi-user access (multiple users can use a single account/organization).

User data is stored and managed in accordance with applicable data security and protection policies within the system.

Certain data can be updated via the dashboard with platform admin approval.
For data deletion, please contact the admin in accordance with applicable policies.

Ya. Seluruh dokumen disimpan secara aman dan hanya dapat diakses oleh pihak berwenang sesuai kebijakan privasi Ship IT.

Pengguna bisa klik “+add cargo planning” yang ada di halaman utama dashboard Ship IT dan mengisi detail muatannya seperti POD, POL, laycan period, time departed dan time arrived serta cargo details.

Pengguna dapat memilih kapal yang tersedia sesuai waktu, jenis, dan kapasitas yang sesuai dengan muatan dan mengajukan permintaan order kepada ship owner.

Cargo owner dapat membuat “+add cargo planning” kembali dan memilih kapal lain yang tersedia dan sesuai dengan kebutuhan muatan.

Fitur Negosiasi adalah fasilitas dalam platform Ship.IT yang memungkinkan Ship Owner dan Cargo Owner melakukan proses tawar-menawar harga, ketentuan charter, serta persyaratan operasional kapal secara transparan dan terdokumentasi.

Negosiasi dapat dilakukan oleh:

Saat ini belum, namun akan menjadi masukan untuk sistem kami kedepannya agar riwayat negosiasi tersimpan di sistem Ship.IT sebagai referensi dan dokumentasi resmi.

Agreement yang berlaku adalah Perjanjian Pengangkutan (Charter / Freight Agreement) yang terbentuk ketika Cargo Owner melakukan booking dan Ship Owner menyetujui pesanan melalui platform Ship IT.

Tidak. Ship IT bertindak sebagai platform perantara (marketplace) dan bukan pihak dalam perjanjian pengangkutan antara Ship Owner dan Cargo Owner, kecuali dinyatakan lain secara tertulis.

Agreement dianggap sah dan mengikat ketika:

Cargo Owner melakukan booking, dan
Ship Owner menyetujui booking tersebut di platform, serta kedua pihak telah menyetujui syarat yang ditampilkan di platform.

Ship Owner bertanggung jawab atas:

Ketersediaan kapal sesuai spesifikasi yang disepakati
Keselamatan dan kelayakan kapal
Proses pengangkutan barang dari pelabuhan muat ke pelabuhan bongkar
Kepatuhan terhadap peraturan pelayaran yang berlaku

Cargo Owner bertanggung jawab atas:

Keakuratan data muatan (jenis, berat, volume, dan sifat barang)
Legalitas dan dokumen kargo
Kesiapan muatan sesuai jadwal
Pembayaran biaya pengangkutan sesuai kesepakatan

Penentuan tarif dan biaya pengangkutan ditetapkan berdasarkan jenis dan volume kargo, rute pelayaran, jenis kapal, durasi perjalanan, serta kondisi pasar. Selain itu, perhitungan juga mempertimbangkan Customary Quick Despatch (CQD), yaitu waktu bongkar muat yang disesuaikan dengan kebiasaan pelabuhan setempat, sehingga biaya lebih realistis dan mencerminkan efisiensi operasional aktual.

Biaya pengangkutan sudah termasuk pajak sesuai dengan ketentuan yang berlaku, kecuali dinyatakan lain dalam kontrak atau perjanjian.

Ya, cargo owner bisa merekomendasikan agen saat pembuatan agreement, dimana ship owner bisa menerima atau menolak rekomendasi agen tersebut sesuai kesepakatan.

Perubahan atau pembatalan hanya dapat dilakukan sesuai dengan:

Ketentuan yang disepakati di awal booking, dan
Status proses pengangkutan saat itu
Biaya pembatalan dapat berlaku sesuai kesepakatan.

Jika terjadi keterlambatan:

Ship Owner wajib memberikan informasi dan alasan keterlambatan
Penyelesaian klaim mengikuti ketentuan dalam agreement dan hukum yang berlaku

Tanggung jawab atas kerusakan atau kehilangan kargo diatur dalam agreement dan bergantung pada:

Penyebab kejadian
Ketentuan asuransi (jika ada)
Bukti dan laporan resmi yang diajukan

Pengguna bisa mengganti nomor handphone di profile dan perlu approve admin platform terlebih dahulu. Setelah itu, pengguna baru bisa akses “process to sign” sehingga link e-sign akan muncul ke nomor whatsapp yang baru.

Tracking shipment adalah fitur untuk memantau status dan posisi pengiriman kargo secara real-time atau berkala sejak proses muat hingga bongkar melalui platform Ship-It.

Ship Owner bertanggung jawab untuk:

Memperbarui status perjalanan kapal
Menginformasikan milestone pengiriman

Ship-It menampilkan informasi tersebut kepada Cargo Owner melalui platform.

Apabila kapal terlambat tiba melampaui batas waktu yang disepakati (di luar kondisi Force Majeure), pemilik kapal akan dikenakan denda keterlambatan per hari sebagai kompensasi kepada Pemilik Kargo yang dirugikan.

Jika terjadi kendala teknis yang memerlukan pergantian kapal, armada pengganti wajib memiliki spesifikasi yang setidak-tidaknya sama atau lebih tinggi tanpa adanya tambahan biaya bagi Pemilik Kargo.

Keterlambatan yang berulang atau kegagalan memenuhi SLA dapat mengakibatkan penurunan rating akun atau penangguhan akses ke paket berlangganan PRO/REGULAR pemilik kapal.

Ship Owner bertanggung jawab penuh atas pengembalian dana pembayaran yang telah diterima sesuai dengan kebijakan pengembalian dana yang berlaku di Aplikasi serha denda pembatalan pesanan.Tarif denda merujuk pada kesepakatan nilai transaksi yang tertera pada fitur pemesanan kapal di Aplikasi Ship IT.

Apabila terjadi keterlambatan pemuatan yang disebabkan oleh ketidaksiapan barang, dokumen kargo yang tidak lengkap, atau kendala administratif dari pihak Cargo Owner, maka akan dikenakan denda keterlambatan (demurrage). Tarif denda harian merujuk pada kesepakatan nilai transaksi yang tertera pada fitur pemesanan kapal di Aplikasi Ship IT.

Pembatalan muatan secara sepihak dapat dikenakan denda pembatalan sesuai kebijakan komersial yang berlaku.

Ship IT memiliki beberapa pilihan paket berlangganan yang dapat disesuaikan dengan kebutuhan Ship Owner sebagai berikut:

Program Insentif Pendaftaran Baru: Sebagai keuntungan eksklusif, Anda mendapatkan Akses Gratis (Free Access) untuk 1 sampai dengan __ kapal pertama yang didaftarkan ke dalam Aplikasi.
Registrasi Perusahaan: Pendaftaran perusahaan ke dalam sistem tidak dikenakan biaya (Gratis), namun akses terbatas hanya untuk keperluan eksplorasi mekanisme sistem.
Paket REGULER (IDR 12.000.000/Tahun/Kapal): Memberikan akses penuh untuk menerima inquiry kargo secara cepat dan melakukan monitoring aset melalui dashboard selama proses pengiriman.

Paket PRO (IDR 30.000.000/Tahun/Kapal): Memberikan seluruh fitur paket Reguler ditambah dengan akses

Fleet Management System

(monitoring kru dan permit sesuai regulasi) serta potongan persentase komisi transaksi.

Untuk setiap transaksi pengiriman yang berhasil diselesaikan, partner akan mendapatkan komisi dengan besaran yang merujuk pada total nilai invoice kargo tersebut:

Betul, sistem Ship.IT mendukung penggunaan multi-user (bisa dipakai oleh banyak pengguna dalam satu akun/organisasi).

Data pengguna disimpan dan dikelola sesuai dengan kebijakan keamanan dan perlindungan data yang berlaku dalam sistem.

Data tertentu dapat diubah melalui dashboard dan dibutuhkan approval admin platform. Untuk penghapusan data, silakan hubungi admin sesuai ketentuan yang berlaku.

TERMS & CONDITIONS

INTRODUCTION

Welcome to the [Application Name] Application (the "Application"). This Application is operated by [Company Name], a limited liability company established under the laws of the Republic of Indonesia and domiciled at [Company Address] ("We" or "Us").

These Terms and Conditions of Use (these "T&C") constitute a legally binding agreement between you (the Vessel Owner or Cargo Owner) and Us, governing your access and use of the Services available through the Application.

By pressing the "Agree" button, or by registering and/or using the Application, you acknowledge that you have read, understood, and agreed to these T&C. If you do not agree to these T&C, you must refrain from further using the Application and the Services.

DEFINITIONS

Application: The digital platform in the form of mobile application and/or website owned and operated by Us.
User: Any party that registers for and uses the Application, consisting of Vessel Owners (Carriers), Cargo Owners (Shippers), licensed brokers, and any legitimate affiliated parties.
Vessel Owner: Individual or business entity Users who own, manage, or operate a vessel and offer cargo transportation services through the Application.
Cargo Owner: Individual or business entity Users who own cargo and seek vessel transportation services through the Application.
Broker: A legally registered entity that possesses the requisite license and acts as an intermediary or agent to bridge the Cargo Owner and the Vessel Owner in cargo transportation services through the Application.
Services: All features and services provided by the Application to facilitate the connection and transaction of domestic Indonesian shipping/sea transportation services.
Transaction: The entire process sequence, starting from cargo or vessel requests, offers, negotiations, booking, electronic contract creation, up to payment, which constitutes an integral part of the service system provided by this Application.
Escrow: A mechanism for the temporary containment of funds managed by an independent third party, which functions to maintain the security of transactions between the service user and the service provider, in accordance with jointly agreed terms and conditions.
Company Data: Information entered by the User during the registration and utilization of the Services, including but not limited to the company name, business license number, office address, vessel data, cargo data, and contact information.
Customs and Shipping Documents: Including, but not limited to: Bill of Lading, Manifest, Certificate of Seaworthiness, Measurement Letter, Port Authority Documents, and other relevant legal documents.
Personal Data: Any data about an individual that is identified and/or identifiable individually or combined with other information, either directly or indirectly, through electronic and/or non-electronic systems.
Electronic Contract: An agreement concluded by parties through an electronic system.
Electronic Signature: A signature consisting of Electronic information that is affixed, associated, or linked with other electronic information, used as a tool for verification and authentication.

SCOPE OF SERVICE

Order & Booking

· Cargo Owners may post, modify, and manage their shipping needs (origin/destination, commodity specification, volume/tonnage, and desired shipping schedule).

· Vessel Owner may post, modify, and manage the availability of their services (including vessel details, loading capacity, technical specifications, certification, and sailing schedule).

· Brokers may facilicate and publish the needs or availability on behalf of the parties they represent.

Offers, Negotiation, and Price Agreement:

· Features enabling Vessel Owners, Cargo Owners, and Brokers to submit, accept, or reject price offers and the relevant Terms & Conditions of carriage.

· Facilitation of negotiations regarding service details, including options for cargo optimization such as backhaul or cargo consolidation.

Scheduling & Routing:

· Provision of dynamic scheduling tools that assist Users in planning sailing times and routes.

· Information considered includes route conditions (including seasonal factors), port operational schedules, and compliance with applicable regulatory requirements.

Electronic Contract:

· Facilitation for final confirmation of the order and the agreement reached by the parties.

· Issuance, signing, and storage of the electronic carriage contract (e-contract) and other supporting documentation relevant to the transaction.

· All documents and agreements facilitated through the Application, including the carriage contract, shall be legally formalized using an Electronic Signature or a Wet Signature (Conventional) on a printed copy, and, if mandated by prevailing laws and regulations or mutual agreement of the Parties, shall be affixed with a Conventional Stamp Duty or Electronic Stamp Duty (e-stamp Duty) in accordance with the applicable legal provisions in the Republic of Indonesia.

Payment:

· Provision of various secure payment method options, such as payment gateways, virtual accounts, and escrow facility (joint account) as an option.

· Determination and management of payment terms (payment stages) in accordance with the agreement reached by the Cargo Owner and the Vessel Owner, subject to these Terms & Conditions.

Tracking: Integration of a comprehensive cargo tracking system, covering manual, hybrid, or automatic identification system (AIS) tracking methods.
Support: Provision of assistance channels, a help center/FAQ, incident reporting, and the presence of a Rapid Response Standby Team.

DOCUMENT LEGALIZATION AND SIGNATURE

Document Legalization: All documents and Agreements, including (but not limited to) carriage contracts and other related agreements, processed or generated by the application shall be legalized and possess binding legal force through:

a. Electronic Signature: The use of an Electronic Signature that fulfils the terms and conditions regulated under the laws and regulations of Indonesia.

b. Conventional Signature: The use of a Wet Signature (manual) on the hardcopy printout of the relevant document, which shall subsequently be uploaded to the application.

c. The user is obliged to warrant that both the Wet Signature and the Electronic Signature used to sign all documents are affixed by an authorized and legitimate representative.

d. The user shall be fully responsible for the security and confidentiality of their Electronic Signature credentials and shall indemnify Us against any claims or losses arising from the misuse of said credentials.

Affixing Stamp Duty: All such documents and Agreements must be affixed with stamp duty pursuant to the provisions of the laws and regulations concerning stamp duty, and shall be affixed using:

a. Electronic Stamp Duty: The affixing of Electronic Stamp Duty in accordance with the prevailing laws and regulations.

b. Physical Stamp Duty: The manual affixing of Physical Duty on the physical copy of the document, which shall then be uploaded to the application.

c. The user hereby agrees that We shall be entitled to charge a fee for the Electronic Stamp Duty, in the event that such Electronic Stamp Duty is provided or facilitated by the Platform.

REGISTRATION AND USER ACCOUNT

Requirements:

a. This Application is designated for legitimate business entities (Vessel Owners and Cargo Owners) that are established and operating under the laws of the Republic of Indonesia.

b. The registrant must possess the legal authority to enter into a binding agreement on behalf of the registered company.

c. The registrant must be the Company Director or a formally appointed authorized representative who possesses the authority, pursuant to a Power of Attorney or relevant company documents, to register and operate the company's account on the Application.

Obligations:

a. Cargo Owner:

· Accuracy of Cargo Information: Must provide and warrant the absolute truth and accuracy of all cargo details uploaded to the Application, including the type of cargo, HS Code (if relevant), weight/volume, type of packaging, and identification of hazardous properties (if any).

· Legality of Cargo and Documents: Must ensure and warrant the lawful ownership, validity of the cargo, and completeness of all required shipping documents.

· Regulatory Compliance: Must comply with all applicable regulations related to port operations, transportation safety, and environmental provisions concerning the cargo being shipped.

b. Vessel Owner:

· Vessel Readiness and Seaworthiness: Must warrant that the vessels offered through the Application are in a seaworthy condition, possess valid certification, are manned by competent personnel, and are covered by adequate and relevant marine insurance.

· Vessel Technical Information: Must provide and warrant the accuracy of the vessel's technical information, including Gross Tonnage (GT)/Deadweight Tonnage (DWT), vessel classification, and safety equipment details.

· Reporting of Incidents and Changes: Must report any schedule changes, significant delays, or incidents occurring during the carriage process to the relevant parties without unreasonable delay.

c. Broker:

· License and Authority: Must possess a valid operational license and warrant that they have adequate authority from the party they represent (Cargo Owner or Vessel Owner) to conduct transactions and conclude agreements through the Application.

· Transparency and Integrity: Must act with integrity, transparency, and in good faith when facilitating communication and negotiations between the Cargo Owner and the Vessel Owner.

· Data Compliance: Must ensure that all information, offers, and documents presented on behalf of their client are accurate and not misleading.

Verification: We reserve the right to request, verify, and store supporting documents to substantiate the company's legal status and the authority of the registering representative, including:

a. Deed of Establishment of the Company (along with the latest amendments).

b. Valid Sea Transportation Business License (Surat Izin Usaha Perusahaan Angkutan Laut).

c. Company Taxpayer Identification Number (Nomor Pokok Wajib Pajak/NPWP).

d. Copy of the Director's or authorized Representative's ID Card/Identification.

e. Power of Attorney from the Director to the representative, should the registrant not be the Company Director.

Account Confidentiality:

a. The registrant warrants that all Company Data and Personal Data entered are accurate, complete, and up-to-date.

b. The registrant understands and agrees that actions and transactions performed through the User account shall legally bind the represented company.

c. You are fully responsible for maintaining the confidentiality and security of your account and password. All activities occurring under your account are the sole responsibility of the company you represent.

One Account: Each business entity or individual is permitted to have only one User account.

PROHIBITED USE

Every User is strictly prohibited from using the Application for the following purposes:

Unlawful Activities: Engaging in or facilitating illegal activities, fraud, money laundering, any form of Doxing and Phishing actions, terrorism financing, or other acts that violate applicable laws and regulations, including breaches of international sanctions and embargoes.
Misuse of Information: Posting, uploading, or disseminating information that is false, misleading, defamatory, or infringes upon the intellectual property rights (IPR) or other rights of third parties.
Circumvention of Official Transactions: Attempting to avoid, circumvent, or bypass the payment system, platform fee mechanism, or other service fees that have been established and mandated by the Application.
System Interference: Taking any action that may damage, disrupt, overload, or impair the functionality, security, or operational integrity of the Application.

ROLE AND RESPONSIBILITY OF THE PLATFORM

Platform Provider: We act solely as a technology platform to bring together Vessel Owners and Cargo Owners. We ARE NOT a provider of carriage services, a vessel operator, or a sender/receiver of cargo.
No Transaction Guarantee: We do not guarantee that every offer published by a Vessel Owner will be accepted by a Cargo Owner, or vice versa. We are not responsible for the quality, safety, legality, or any aspect of the cargo, vessel, or carriage services offered or provided by the Users.
Contractual Responsibility: All agreements and carriage contracts occurring between the Vessel Owner and the Cargo Owner outside the technical scope of the Application (e.g., cargo condition, damage, delays) are the full responsibility of each respective party.

FEES, TAXES, AND PAYMENT

The fee structure (platform fee/commission, additional service fees) shall be informed on [Website URL] and/or on the transaction screen.
Prices are exclusive of any taxes, duties, or other levies unless otherwise stated.
Billing shall be executed via electronic invoice; late payments may incur penalties in accordance with the stipulated provisions.

CANCELLATION, AMENDMENT, REFUND, AND ADDITIONAL CHARGES

Any request for amendment or cancellation of a Booking submitted by the Cargo Owner through the Platform shall be facilitated by Us to the Vessel Owner. However, the approval, refund provisions, and application of penalties and charges (including Our Service Fees and the Vessel Owner's Penalties/Charges) shall be fully subject to the authority of the Vessel Owner and the agreed contractual terms and conditions, with the Cargo Owner acknowledging that certain Booking elements may be non-refundable.
Should the Booking Confirmation be amended, rescheduled, or cancelled by the Vessel Owner, We shall facilitate your request for a refund or rescheduling to the Vessel Owner as requested; however, the Booker acknowledges that the approval, refund terms (full or partial), and processing time are entirely subject to the Vessel Owner's terms and conditions and policy, and We provide no guarantee as to the outcome of such request.
Should the Cargo Owner submit a request for rescheduling, modification, or amendment (including add-ons) directly to the Vessel Owner without utilizing the official Platform features, the Cargo Owner agrees that:
We shall be released from the obligation to update the Booking data or convey related amendment information, and
We shall not be liable for any losses, claims, or legal consequences arising from changes performed outside the Platform.
Refund Process: Subject to the provisions of the payment processing facility, any refund, whether voluntary or otherwise, shall in principle be processed through your initial payment method. If the refund cannot be executed through the initial method, the funds shall be transferred to a Designated Bank Account registered by you upon submission of the refund request on the Platform, whereby you assume full responsibility for the accuracy and validity of the details provided. We reserve the right to withhold and/or deny the transfer of a refund to a Designated Bank Account if there is reasonable suspicion regarding a violation of law (including money laundering, terrorism financing, or fraud), and in such cases, We may report the matter to the relevant authorities in accordance with applicable legal obligations.

Furthermore, to the extent permitted by law, We reserve the right not to proceed with the refund processing if:

the refund to the initial payment method fails;
you fail to provide accurate, valid, or discoverable details of the Designated Bank Account by the bank system; or
you cannot be reached or fail to provide a response after We have made reasonable communication attempts.

TERMS AND CONDITIONS FOR REFUND ACCOUNT

By providing the bank account details on the Refund Request page within the Platform, the Booker expressly represents that they have read, understood, and agreed to the entirety of these provisions, including but not limited to the Platform Terms and Conditions and the applicable refund procedures:

Obligation of Accuracy: You are obliged to provide one correct and accurate bank account number for the refund processing. The registered account number shall be the sole transfer destination for all refund requests on the Platform.
Account Ownership: Refunds can only be processed through the same Platform user account that was utilized to make the initial booking.
Legal Purpose and Booker's Representation: You represent and warrant that the purpose of the refund is not for criminal acts, including but not limited to money laundering, terrorism financing, or fraud.
Platform's Right to Withhold Funds: We reserve the right, to the extent permitted by applicable law, to withhold or cancel the refund process if you or the refund process is reasonably suspected of being involved in or containing elements of criminal acts. We may request additional information (such as copies of identification) if necessary for a legitimate refund process.
Limitation of Liability: You shall indemnify and hold Us harmless from any obligation or liability arising from:
The utilization purpose of the refund by You,
Any unlawful acts conducted through this refund process, and;
Any losses resulting from incorrect or inaccurate account information provided by You.

DOCUMENTS, COMPLIANCE, AND BANKRUPTCY

Document Obligation:

The User shall be obliged to provide and/or upload all required documents, including but not limited to KYC/KYB documents, business licenses, vessel certifications, manifests, bills of lading (B/L), and other supporting documents as requested by the Platform.

Verification and Inspection:

The Platform reserves the right to perform verification and inspection of the User's documents and information, either internally or through authorized third parties collaborating with us.

Non-Compliance:Should the User fail to fulfill document obligations or other compliance requirements, the Platform reserves the right to postpone the process, suspend the account, and/or cancel the transaction in accordance with the prevailing policy.

INSURANCE & RISK LIABILITY

Insurance Obligation:

The User is responsible for arranging and/or obtaining the necessary insurance coverage, including but not limited to cargo insurance, Protection & Indemnity (P&I), or other forms of insurance relevant to the transactions performed through the Platform.

Limitation of Liability:

[Company Name/PT] does not act as the carrier of record, broker, or freight forwarder, unless otherwise expressly stated in writing by [Company Name/PT].

Risk Allocation:

All forms of operational risk, legal responsibility, and liability arising from the relationship between the Cargo Owner and the Vessel Owner shall be the responsibility of each respective party and are subject to the provisions regulated in the contract between them.

LIMITATION OF LIABILITY

Provision of Services:

The Services are provided "as is" and "as available," to the extent permitted by applicable law. [Company Name/PT] makes no warranties, either express or implied, regarding the availability, reliability, or fitness of the services for a particular purpose.

Limitation of Damages:

[Company Name/PT] shall not be liable for indirect, incidental, special, consequential damages, loss of profits, loss of data, or other forms of loss arising out of or in connection with the use of the services.

Maximum Liability Cap:

To the extent permitted by law, the total aggregate liability of [Company Name/PT] for any claim, demand, or loss arising from or related to the use of these services shall be limited to the amount of service fees paid by the User in connection with the subject services.

SYSTEM SECURITY AND INTEGRITY

User Responsibility:

The User is responsible for maintaining the confidentiality of account credentials (including usernames, passwords, and access tokens) and preventing any form of unauthorized access to the account or system. All activities occurring through the User account shall be deemed to be actions performed by the User concerned.

API Access and System Users:

The use of APIs or other system integrations is subject to specific agreements, rate limits, and security policies established by [Company Name/PT]. [Company Name/PT] reserves the right to restrict or revoke API access if use is found to violate security provisions or potentially compromise system stability.

Prohibition of System Damaging Activities:

The User is prohibited from engaging in acts that may disrupt, damage, or penetrate the security system, including but not limited to hacking, reverse engineering, excessive data retrieval (scraping), or other attempts to bypass security controls implemented by [Company Name/PT].

SERVICE AVAILABILITY AND SLA

System Availability:

[Company Name/PT] strives to maintain a high level of system uptime to ensure optimal access to the services. However, the User understands that scheduled maintenance, system updates, or technical disruptions beyond the control of [Company Name/PT] may cause the services to be temporarily unavailable.

Notification of Disruption and Maintenance:

Any scheduled downtime or maintenance activities shall be communicated in advance through the official communication channels established by [Company Name/PT].

Operational Support and Response Time:

Operational support services shall be provided during the established working hours. Information regarding service hours, support channels, and estimated response time shall be announced on the Help Center page or other official channels.

INTELLECTUAL PROPERTY RIGHTS

The Application, including but not limited to its name, source code, design, graphics, and content, is protected by copyright and other Intellectual Property Rights belonging to Us.
Users are not permitted to copy, modify, distribute, or utilize any part of the Application without Our prior written consent.

AMENDMENT OF T&C

We reserve the right to amend, modify, or replace these T&C at any time. The amendments shall become effective upon being uploaded to the Application. By continuing to use the Application following the amendment of the T&C, you shall be deemed to have agreed to the revised T&C.

FORCE MAJEURE

Definition and Scope:

The Parties shall be exempt from liability and/or delay in the performance of obligations arising from the occurrence of events beyond reasonable control (force majeure), including but not limited to natural disasters, war, civil commotion, mass strikes, government policy or actions, pandemics, epidemics, outbreaks of disease, communication system or network disruption, or other similar circumstances that are beyond the reasonable ability of the parties to control.

Impact and Notification:

The Party affected by the force majeure event shall immediately notify the other party in writing no later than 3 (three) Working Days after the Force Majeure event occurs.

DISPUTE RESOLUTION

Any dispute arising from these T&C shall be resolved through deliberation (musyawarah). If no agreement is reached, the parties agree to settle the dispute through [Choose: the District Court of North Jakarta (Pengadilan Negeri Jakarta Utara) or the Indonesian National Arbitration Board (Badan Arbitrase Nasional Indonesia/BANI)].

PENDAHULUAN

DEFINISI

Aplikasi: Platform digital berupa aplikasi mobile dan/atau situs web yang dimiliki dan dioperasikan oleh Kami.
Pengguna: Setiap pihak yang mendaftar dan menggunakan Aplikasi, terdiri dari Pemilik Kapal (Carrier), Pemilik Kargo (Shipper), broker yang memiliki izin, serta pihak terafiliasi yang sah.
Pemilik Kapal: Pengguna perorangan atau badan usaha yang memiliki, mengelola, atau mengoperasikan kapal dan menawarkan jasa pengangkutan muatan (kargo) melalui Aplikasi.
Pemilik Kargo: Pengguna perorangan atau badan usaha yang memiliki muatan (kargo) dan mencari jasa pengangkutan kapal melalui Aplikasi.
Broker: Badan hukum yang memiliki izin dan bertindak sebagai perantara atau agen untuk menjembatani Pemilik Kargo dan Pemilik Kapal dalam layanan pengangkutan muatan (kargo) melalui Aplikasi.
Layanan: Segala fitur dan layanan yang disediakan oleh Aplikasi untuk memfasilitasi pertemuan dan transaksi jasa pelayaran/angkutan laut domestik Indonesia.
Transaksi: seluruh rangkaian proses mulai dari permintaan muatan atau kapal, penawaran, negosiasi, pemesanan (booking), pembuatan kontrak elektronik, hingga pembayaran, merupakan bagian integral dari sistem layanan yang disediakan oleh aplikasi ini.
Escrow: mekanisme penampungan dana sementara yang dikelola oleh pihak ketiga independen, yang berfungsi untuk menjaga keamanan transaksi antara pihak pengguna dan penyedia layanan, sesuai dengan syarat dan ketentuan yang telah disepakati bersama.
Data Perusahaan: Informasi yang dimasukkan oleh Pengguna pada saat registrasi dan penggunaan Layanan, termasuk namun tidak terbatas pada nama perusahaan, nomor izin usaha, alamat kantor, data kapal, data kargo, dan informasi kontak.
Dokumen Kepabeanan & Pelayaran: mencakup namun tidak terbatas pada: Surat Muatan Laut/Bill of Lading, Manifest, Sertifikat Kelaiklautan Kapal, Surat Ukur, Dokumen Kesyahbandaran, dan dokumen hukum terkait lainnya.
Data Pribadi: Setiap data tentang seseorang baik yang teridentifikasi dan/atau dapat diidentifikasi secara tersendiri atau dikombinasi dengan informasi lainnya baik secara langsung maupun tidak langsung melalui sistem elektronik dan/atau non-elektronik.
Kontrak Elektronik: perjanjian yang dibuat para pihak melalui sistem elektronik.
Tanda Tangan Elektronik: tanda tangan yang terdiri dari atas informasi Elektronik yang dilekatkan, terasosiasi atau terkait dengan informasi elektronik lainnya yang digunakan sebagai alat verifikasi dan autentikasi.

RUANG LINGKUP LAYANAN

Order & Booking:

Pemilik Kargo dapat memposting, mengubah, dan mengelolah kebutuhan pengiriman (asal/tujuan, spesifikasi komoditas, volume/tonase, dan jadwal pengangkutan yang diinginkan).
Pemilik Kapal dapat memposting, mengubah, dan mengelola ketersediaan layanan mereka (termasuk detail kapal, kapasitas muat, spesifikasi teknis, sertifikasi, dan jadwal pelayaran).
Broker dapat memfasilitasi dan mempublikasikan kebutuhan atau ketersediaan atas nama pihak yang mereka wakili.

Penawaran, Negosiasi dan Kesepakatan Harga:

Fitur yang memungkinkan Pemilik Kapal, Pemilik Kargo, dan Broker untuk mengajukan, menerima, atau menolak penawaran harga dan Syarat & Ketentuan pengangkutan.
Fasilitasi negosiasi mengenai detail layanan, termasuk opsi untuk optimalisasi muatan seperti backhaul (muatan balik) atau konsolidasi kargo.

Scheduling & Routing:

Penyediaan alat penjadwalan dinamis yang membantu pengguna dalam merencanakan waktu dan rute pelayaran.
Informasi yang dipertimbangkan meliputi kondisi rute (termasuk faktor musiman), jadwal operasional pelabuhan, dan pemenuhan ketentuan kepatuhan/regulasi yang berlaku.

Kontrak Elektronik:

Fasilitasi untuk konfirmasi akhir atas pesanan dan kesepakatan yang telah dicapai oleh para pihak.
Penerbitan, penandatanganan, dan penyimpanan dokumen kontrak pengangkutan elektronik (e-contract) serta dokumentasi pendukung lainnya yang relevan dengan transaksi.
Seluruh dokumen dan perjanjian yang difasilitasi melalui Aplikasi, termasuk kontrak pengangkutan, akan disahkan menggunakan Tanda Tangan Elektronik atau Tanda Tangan Basah (Konvensional) pada salinan cetak, dan, apabila diwajibkan oleh peraturan perundang-undangan atau kesepakatan Para Pihak, akan dibubuhi Meterai Konvensional atau Meterai Elektronik (e-Meterai) sesuai dengan ketentuan hukum yang berlaku di Republik Indonesia.

Pembayaran:

Penyediaan berbagai opsi metode pembayaran yang aman, seperti payment gateway, virtual account, dan fasilitas escrow (rekening bersama) sebagai opsi.
Penentuan dan pengelolaan termin pembayaran (tahapan pembayaran) sesuai dengan kesepakatan yang dicapai oleh Pemilik Kargo dan Pemilik Kapal, dengan tunduk pada Syarat & Ketentuan ini.

Pelacakan: Integrasi sistem pelacakan muatan yang komprehensif, meliputi metode pelacakan manual, hybrid, atau melalui sistem identifikasi otomatis (Automatic Identification System/AIS).
Dukungan: Kanal bantuan, pusat bantuan/FAQ, dan pelaporan insiden serta adanya Tim Siaga Cepat Tanggap.

PENGESAHAN DOKUMEN DAN LEGALITAS

Pengesahan dan Penandatangan Dokumen: Seluruh dokumen dan Perjanjian, termasuk (namun tidak terbatas pada) kontrak pengangkutan dan perjanjian lain yang terkait, yang diproses atau dihasilkan oleh aplikasi akan disahkan dan memiliki kekuatan hukum yang mengikat melalui:
Tanda Tangan Elektronik: Penggunaan Tanda Tangan Elektronik yang memenuhi syarat dan ketentuan yang diatur dalam peraturan perundang-undangan di Indonesia.
Tanda Tangan Konvensional: Penggunaan Tanda Tangan Basah (manual) pada salinan cetak hardcopy dokumen terkait, yang kemudian akan diunggah pada aplikasi.
Pengguna wajib menjamin bahwa baik Tanda Tangan Basah maupun Tanda Tangan Elektronik yang digunakan untuk menandatangani seluruh dokumen dilakukan oleh perwakilan yang sah dan berwenang.
Pengguna bertanggung jawab penuh atas keamanan dan kerahasiaan kredensial Tanda Tangan Elektronik yang dimilikinya dan membebaskan Kami dari segala klaim atau kerugian yang timbul akibat penyalahgunaan kredensial tersebut.
Pembubuhan Meterai: Terhadap seluruh dokumen dan Perjanjian tersebut wajib dibubuhi meterai berdasarkan ketentuan perundang-undangan mengenai bea meterai, wajib dibubuhi meterai dengan menggunakan:
Meterai Elektronik: Pembubuhan Meterai Elektronik sesuai dengan peraturan perundang-undangan yang berlaku.
Meterai Fisik: Pembubuhan Meterai secara manual pada salinan fisik dokumen yang kemudian akan diunggah ke aplikasi.
Pengguna dengan ini setuju bahwa Kami berhak untuk membebankan biaya atas Meterai Elektronik, dalam hal Meterai Elektronik tersebut disediakan atau difasilitasi oleh Platform.

REGISTRASI DAN AKUN PENGGUNA

Persyaratan:
Aplikasi ini ditujukan untuk entitas bisnis (Pemilik Kapal dan Pemilik Kargo) yang sah dan beroperasi berdasarkan hukum Republik Indonesia.
Pendaftar harus memiliki kewenangan hukum untuk mengadakan perjanjian yang mengikat atas nama perusahaan yang didaftarkan.
Pendaftar wajib merupakan Direktur perusahaan atau perwakilan resmi yang ditunjuk secara sah dan memiliki kewenangan berdasarkan Surat Kuasa atau dokumen perusahaan yang relevan untuk mendaftarkan dan mengoperasikan akun perusahaan di Aplikasi.
Kewajiban:
Pemilik Kargo:

Akurasi Informasi Muatan: Wajib menyediakan dan menjamin kebenaran serta akurasi mutlak atas semua detail muatan yang diunggah ke Aplikasi, termasuk jenis muatan, Kode HS (jika relevan), berat/volume, jenis kemasan, dan identifikasi sifat bahaya (jika ada).
Legalitas Muatan dan Dokumen: Wajib memastikan dan menjamin kepemilikan yang sah, keabsahan muatan, dan kelengkapan semua dokumen pengiriman yang dipersyaratkan.
Kepatuhan Regulasi: Wajib mematuhi semua peraturan yang berlaku terkait operasional pelabuhan, keselamatan pengangkutan, dan ketentuan lingkungan hidup terkait muatan yang dikirim.

Pemilik Kapal:

Kesiapan dan Kelaiklautan Kapal: Wajib menjamin bahwa kapal yang ditawarkan melalui Aplikasi berada dalam kondisi laik laut (seaworthy), memiliki sertifikasi yang valid, diawaki oleh personel yang kompeten, dan dilindungi oleh asuransi pengangkutan yang memadai dan relevan.
Informasi Teknis Kapal: Wajib menyediakan dan menjamin keakuratan informasi teknis kapal, termasuk Gross Tonnage (GT)/Deadweight Tonnage (DWT), klasifikasi kapal, dan detail peralatan keselamatan.
Pelaporan Insiden dan Perubahan: Wajib melaporkan setiap perubahan jadwal, keterlambatan signifikan, atau insiden yang terjadi selama proses pengangkutan kepada pihak terkait tanpa penundaan yang tidak beralasan.

Broker:

Izin dan Wewenang: Wajib memiliki izin operasional yang sah dan menjamin bahwa mereka memiliki wewenang yang memadai dari pihak yang diwakilinya (Pemilik Kargo atau Pemilik Kapal) untuk melakukan transaksi dan membuat kesepakatan melalui Aplikasi.
Transparansi dan Integritas: Wajib bertindak dengan integritas, transparansi, dan dalam itikad baik dalam memfasilitasi komunikasi dan negosiasi antara Pemilik Kargo dan Pemilik Kapal.
Kepatuhan Data: Wajib memastikan bahwa semua informasi, penawaran, dan dokumen yang disajikan atas nama kliennya adalah akurat dan tidak menyesatkan.

Verifikasi: Kami berhak untuk meminta, memverifikasi, dan menyimpan dokumen pendukung untuk membuktikan status hukum perusahaan dan kewenangan perwakilan yang mendaftar, termasuk:
Akta Pendirian Perusahaan (beserta perubahan terakhir).
Surat Izin Usaha Perusahaan Angkutan Laut yang masih berlaku.
Nomor Pokok Wajib Pajak (NPWP) Perusahaan.
Salinan KTP/Identitas Direktur atau Perwakilan yang sah.
Surat Kuasa dari Direktur kepada perwakilan, jika pendaftar bukan Direktur Perusahaan.
Kerahasiaan Akun:
Pendaftar menjamin bahwa semua Data Perusahaan dan Data Pribadi yang dimasukkan adalah akurat, lengkap, dan terkini.
Pendaftar memahami dan menyetujui bahwa tindakan dan transaksi yang dilakukan melalui akun Pengguna akan mengikat perusahaan secara hukum.
Anda bertanggung jawab penuh untuk menjaga kerahasiaan dan keamanan akun serta kata sandi Anda. Semua aktivitas yang terjadi di bawah akun Anda adalah tanggung jawab perusahaan yang Anda wakili.
Satu Akun: Setiap entitas bisnis atau perorangan hanya diperbolehkan memiliki satu akun Pengguna.

LARANGAN PENGGUNAAN

Setiap Pengguna dilarang keras untuk menggunakan Aplikasi untuk tujuan-tujuan berikut:

Aktivitas Melanggar Hukum: Melakukan atau memfasilitasi aktivitas ilegal, penipuan (fraud), pencucian uang (money laundering), segala bentuk tindakan Doxing dan Phishing, pendanaan terorisme, atau tindakan lain yang melanggar hukum dan peraturan perundang-undangan yang berlaku, termasuk pelanggaran terhadap sanksi dan embargo internasional.
Penyalahgunaan Informasi: Memposting, mengunggah, atau menyebarkan informasi yang palsu, menyesatkan, mencemarkan nama baik, atau melanggar hak kekayaan intelektual (HAKI) atau hak-hak lain milik pihak ketiga.
Penghindaran Transaksi Resmi: Berupaya untuk menghindari, memotong (circumvent), atau mengakali sistem pembayaran, mekanisme platform fee, atau biaya layanan lain yang telah ditetapkan dan diwajibkan oleh Aplikasi.
Gangguan Sistem: Melakukan tindakan apa pun yang dapat merusak, mengganggu, membebani, atau mempengaruhi fungsionalitas, keamanan, atau integritas operasional Aplikasi.

PERAN DAN TANGGUNG JAWAB PLATFORM

Penyedia Platform: Kami bertindak semata-mata sebagai platform teknologi untuk mempertemukan Pemilik Kapal dan Pemilik Kargo. Kami BUKAN penyedia jasa pengangkutan, operator kapal, atau pengirim/penerima kargo.
Tidak Ada Jaminan Transaksi: Kami tidak menjamin bahwa setiap penawaran yang dipublikasikan oleh Pemilik Kapal akan diterima oleh Pemilik Kargo, atau sebaliknya. Kami tidak bertanggung jawab atas kualitas, keamanan, legalitas, atau aspek apa pun dari kargo, kapal, atau jasa pengangkutan yang ditawarkan atau disediakan oleh Pengguna.
Tanggung Jawab Kontrak: Semua kesepakatan dan kontrak pengangkutan yang terjadi antara Pemilik Kapal dan Pemilik Kargo di luar lingkup teknis Aplikasi (misalnya, kondisi kargo, kerusakan, keterlambatan) adalah tanggung jawab penuh masing-masing pihak.

BIAYA, PAJAK, DAN PEMBAYARAN

Struktur biaya (platform fee/komisi, biaya layanan tambahan) akan diinformasikan di [URL Situs] dan/atau pada layar transaksi.
Harga tidak termasuk pajak, bea, atau pungutan lain kecuali dinyatakan lain.
Penagihan melalui invoice elektronik; keterlambatan pembayaran dapat dikenakan denda sesuai ketentuan.

PEMBATALAN, PERUBAHAN, PENGEMBALIAN DANA (REFUND) DAN BIAYA TAMBAHAN

Setiap permintaan perubahan atau pembatalan Pemesanan yang diajukan oleh Pemilik Kargo melalui Platform akan difasilitasi oleh Kami kepada Pemilik Kapal, namun persetujuan, ketentuan pengembalian dana (refund), serta penerapan denda dan biaya (termasuk Biaya Jasa Kami dan Denda/Biaya Pemilik Kapal) sepenuhnya tunduk pada kewenangan Pemilik Kapal dan syarat serta ketentuan kontrak yang disepakati, dengan Pemilik Kargo menyadari bahwa elemen Pemesanan tertentu mungkin bersifat non-refundable.
Apabila Konfirmasi Pemesanan diubah, dijadwalkan ulang, atau dibatalkan oleh Pemilik Kapal, Kami akan memfasilitasi pengajuan pengembalian dana (refund) atau penjadwalan ulang (reschedule) Anda kepada Pemilik Kapal sesuai permintaan; namun, Pemesan mengakui bahwa persetujuan, ketentuan pengembalian dana (penuh atau sebagian), dan waktu pemrosesan sepenuhnya tunduk pada syarat dan ketentuan serta kebijakan Pemilik Kapal, dan Kami tidak memberikan jaminan atas hasil permintaan tersebut.
Apabila Pemilik Kargo mengajukan penjadwalan ulang (reschedule), modifikasi, atau perubahan (termasuk add-on) secara langsung kepada Pemilik Kapal tanpa melalui fitur resmi Platform, Pemilik Kargo menyetujui bahwa:
Kami dibebaskan dari kewajiban untuk memperbarui data Pemesanan atau menyampaikan informasi perubahan terkait, dan
Kami tidak bertanggung jawab atas segala kerugian, klaim, atau konsekuensi hukum yang timbul dari perubahan yang dilakukan di luar Platform.
Proses Pengembalian Dana (Refund) Tunduk pada ketentuan fasilitas pemrosesan pembayaran, pengembalian dana (refund), baik sukarela maupun tidak, pada prinsipnya akan diproses melalui metode pembayaran awal yang digunakan Anda. Jika pengembalian dana tidak dapat dilakukan melalui metode awal, dana akan ditransfer ke Rekening Bank Tertentu yang didaftarkan oleh Anda pada saat pengajuan refund di Platform, di mana Anda bertanggung jawab penuh atas keakuratan dan keabsahan rincian yang diberikan. Kami berhak untuk menahan dan/atau menolak transfer refund ke Rekening Bank Tertentu apabila terdapat kecurigaan wajar mengenai pelanggaran undang-undang (termasuk pencucian uang, pendanaan terorisme, atau penipuan), dan dalam kasus tersebut, Kami dapat melaporkannya kepada pihak berwenang sesuai dengan kewajiban hukum yang berlaku.

Selanjutnya, sejauh diizinkan oleh hukum, Kami berhak untuk tidak melanjutkan pemrosesan refund apabila:

pengembalian ke metode pembayaran awal gagal
Anda gagal memberikan rincian Rekening Bank Tertentu yang akurat, valid, atau dapat ditemukan oleh sistem bank, atau
Anda tidak dapat dihubungi atau gagal memberikan tanggapan setelah Kami melakukan upaya komunikasi yang wajar."

SYARAT DAN KETENTUAN REKENING UNTUK REFUND

Dengan mencantumkan detail rekening pada halaman pengajuan Pengembalian Dana (Refund) di Platform, Pemesan secara tegas menyatakan telah membaca, memahami, dan menyetujui seluruh isi dari ketentuan ini, termasuk namun tidak terbatas pada Syarat dan Ketentuan Platform serta prosedur refund yang berlaku:

Kewajiban Akurasi: Anda wajib mencantumkan satu nomor rekening bank yang benar dan akurat untuk pemrosesan refund. Nomor rekening yang terdaftar tersebut akan menjadi satu-satunya tujuan transfer untuk semua permintaan pengembalian dana di Platform.
Kepemilikan Akun: Pengembalian dana hanya dapat diproses melalui akun pengguna Platform yang sama yang digunakan untuk melakukan pemesanan awal.
Tujuan Hukum dan Pernyataan Pemesan: Anda menyatakan dan menjamin bahwa peruntukan pengembalian dana bukan untuk tujuan tindak pidana kejahatan, termasuk namun tidak terbatas pada pencucian uang, pendanaan terorisme, atau penipuan.
Hak Platform untuk Menahan Dana: Kami berhak, sejauh diizinkan oleh hukum yang berlaku, untuk menahan atau membatalkan proses pengembalian dana jika Anda atau proses refund tersebut diduga terlibat atau memiliki unsur tindak kriminal. Kami dapat meminta informasi tambahan (seperti salinan identitas) jika diperlukan untuk proses refund yang sah.
Batasan Tanggung Jawab: Anda membebaskan Kami dari segala kewajiban atau tanggung jawab atas:
Peruntukan pengembalian dana oleh Anda,
Segala tindakan melanggar hukum melalui proses refund ini, dan
Segala kerugian yang timbul akibat informasi rekening yang tidak benar atau tidak akurat yang dicantumkan oleh Anda.

DOKUMEN, KEPATUHAN DAN KEPAILITAN

Kewajiban dokumen:

Pengguna wajib menyediakan dan/atau mengunggah seluruh dokumen yang diperlukan, termasuk namun tidak terbatas pada dokumen KYC/KYB, perizinan usaha, sertifikasi kapal, manifest, bill of lading (B/L), serta dokumen pendukung lain sebagaimana diminta oleh Platform.

Verifikasi dan Pemeriksaan:

Platform berhak melakukan verifikasi dan pemeriksaan terhadap dokumen dan informasi Pengguna, baik secara internal maupun melalui pihak ketiga yang berizin dan bekerja sama dengan kami.

Ketidakpatuhan:

Apabila Pengguna tidak memenuhi kewajiban dokumen atau persyaratan kepatuhan lainnya, Platform berhak untuk menunda proses, menangguhkan akun, dan/atau membatalkan transaksi sesuai kebijakan yang berlaku.

ASURANSI & TANGGUNG JAWAB RISIKO

Kewajiban Asuransi:

Pengguna bertanggung jawab untuk mengatur dan/atau memperoleh perlindungan asuransi yang diperlukan, termasuk namun tidak terbatas pada asuransi kargo (cargo insurance), Protection & Indemnity (P&I), atau bentuk asuransi lain yang relevan dengan transaksi yang dilakukan melalui Platform.

Batasan Tanggung Jawab:

[Nama Perusahaan/PT] tidak bertindak sebagai pengangkut (carrier of record), broker, maupun freight forwarder, kecuali secara tegas dinyatakan lain secara tertulis oleh [Nama Perusahaan/PT].

Pembagian Risiko:

Segala bentuk risiko operasional, tanggung jawab hukum, dan kewajiban yang timbul dari hubungan antara Pemilik Kargo dan Pemilik Kapal merupakan tanggung jawab masing-masing pihak dan tunduk pada ketentuan yang diatur dalam kontrak di antara mereka.

BATASAN TANGGUNG JAWAB

Penyediaan Layanan:

Layanan disediakan “apa adanya” (as is) dan “sebagaimana tersedia” (as available), sejauh diizinkan oleh hukum yang berlaku. [Nama Perusahaan/PT] tidak memberikan jaminan, baik tersurat maupun tersirat, mengenai ketersediaan, keandalan, atau kesesuaian layanan untuk tujuan tertentu.

Pembatasan Kerugian:

[Nama Perusahaan/PT] tidak bertanggung jawab atas kerugian tidak langsung, insidental, khusus, konsekuensial, kehilangan keuntungan, kehilangan data, atau bentuk kerugian lain yang timbul akibat atau sehubungan dengan penggunaan layanan.

Batas Tanggung Jawab Maksimum:

Sejauh diizinkan oleh hukum, total tanggung jawab [Nama Perusahaan/PT] atas setiap klaim, tuntutan, atau kerugian yang timbul dari atau terkait dengan penggunaan layanan ini dibatasi hingga jumlah biaya layanan yang telah dibayarkan oleh Pengguna sehubungan dengan layanan yang bersangkutan.

KEAMANAN DAN INTEGRITAS SISTEM

Tanggung Jawab Pengguna:

Pengguna bertanggung jawab untuk menjaga kerahasiaan kredensial akun (termasuk nama pengguna, kata sandi, dan token akses) serta mencegah setiap bentuk akses tidak sah terhadap akun atau sistem. Segala aktivitas yang terjadi melalui akun Pengguna akan dianggap sebagai tindakan yang dilakukan oleh Pengguna yang bersangkutan.

Akses API dan Pengguna Sistem:

Penggunaan API atau integrasi sistem lainnya tunduk pada perjanjian khusus, batas laju akses (rate limit), serta kebijakan keamanan yang ditetapkan oleh [Nama Perusahaan/PT]. [Nama Perusahaan/PT] berhak membatasi atau mencabut akses API apabila ditemukan penggunaan yang melanggar ketentuan keamanan atau berpotensi mengganggu stabilitas sistem.

Larangan Aktivitas yang Merusak Sistem:

Pengguna dilarang melakukan tindakan yang dapat mengganggu, merusak, atau menembus sistem keamanan, termasuk namun tidak terbatas pada peretasan (hacking), rekayasa balik (reverse engineering), pengambilan data secara berlebihan (scraping), atau upaya lain untuk menghindari kontrol keamanan yang diterapkan oleh [Nama Perusahaan/PT].

KETERSEDIAAN LAYANAN DAN SLA

Ketersediaan Sistem:

[Nama Perusahaan/PT] berupaya untuk menjaga tingkat ketersediaan (uptime) sistem yang tinggi agar layanan dapat diakses secara optimal. Namun, Pengguna memahami bahwa pemeliharaan terjadwal, pembaruan sistem, atau gangguan teknis di luar kendali [Nama Perusahaan/PT] dapat menyebabkan layanan tidak tersedia sementara waktu.

Pemberitahuaan Gangguan dan Pemeliharaan:

Setiap downtime atau kegiatan pemeliharaan terjadwal akan diinformasikan sebelumnya melalui kanal komunikasi resmi yang ditetapkan oleh [Nama Perusahaan/PT].

Dukungan Operasional dan Waktu Tanggapan:

Layanan dukungan operasional (operational support) disediakan selama jam kerja yang ditetapkan. Informasi mengenai jam layanan, saluran dukungan, serta perkiraan waktu tanggapan (response time) akan diumumkan pada halaman Pusat Bantuan (Help Center) atau kanal resmi lainnya.

HAK KEKAYAAN INTELEKTUAL

Aplikasi, termasuk namun tidak terbatas pada nama, kode program, desain, grafik, dan konten, dilindungi oleh hak cipta dan Hak Kekayaan Intelektual lainnya milik Kami.
Pengguna tidak diperkenankan untuk menyalin, memodifikasi, mendistribusikan, atau menggunakan bagian mana pun dari Aplikasi tanpa persetujuan tertulis dari Kami.

PERUBAHAN S&K

Kami berhak untuk mengubah, memodifikasi, atau mengganti S&K ini sewaktu-waktu. Perubahan akan berlaku efektif setelah diunggah ke Aplikasi. Dengan terus menggunakan Aplikasi setelah perubahan S&K, Anda dianggap menyetujui S&K yang telah direvisi.

FORCE MAJEURE

Definisi dan Ruang Lingkup:

Para Pihak dibebaskan dari tanggung jawab dan/atau keterlambatan dalam pelaksanaan kewajiban yang timbul akibat terjadinya peristiwa di luar kendali wajar (force majeure), termasuk namun tidak terbatas pada bencana alam, perang, kerusuhan, pemogokan massal, kebijakan atau tindakan pemerintah,pandemi, epidemi, wabah penyakit gangguan sistem atau jaringan komunikasi, atau keadaan lain yang serupa yang berada di luar kemampuan wajar para pihak untuk mengendalikannya.

Dampak dan Pemberitahuan:

Pihak yang terdampak oleh peristiwa force majeure wajib segera memberitahukan secara tertulis kepada pihak lainnya dalam waktu selambat-lambatnya 3 (tiga) hari Kerja setelah peristiwa Force Majeure tersebut terjadi.

PENYELESAIAN SENGKETA

Setiap perselisihan yang timbul dari S&K ini akan diselesaikan secara musyawarah. Jika tidak tercapai kesepakatan, maka para pihak setuju untuk menyelesaikan sengketa melalui [Pilih: Pengadilan Negeri Jakarta Utara atau Badan Arbitrase Nasional Indonesia (BANI)].

ACKNOWLEDGEMENT AND CONSENT

Primary Consent: By checking the available consent box and/or by continuing to use this platform, the User explicitly acknowledges having read, understood, and agreed to all provisions in our Privacy Policy and expressly grants Us consent to process the Personal Data and Company Data in accordance with said provisions.
Third-Party Data: If the User provides Personal Data relating to other individuals (e.g., staff, cargo representatives, or business partners), the User represents and warrants that they have obtained the valid consent of such individuals for the Processing of their Personal Data by Us. We reserve the right to request proof of such consent at any time.
Confidentiality Obligation of Other Users' Data: The User undertakes to use the Personal Data of other Users or Partners received while utilizing the Application solely for the purpose of service usage. The Booker shall be fully responsible for any misuse of Personal Data committed and shall indemnify Us against all liabilities related to such misuse.
Withdrawal of Consent: The User may withdraw consent for the Processing of Personal Data or consent to receive marketing communications at any time, by providing reasonable written notice. The User understands and acknowledges that such withdrawal of consent may result in the inability to further use the Application or Our services, including the cessation of services or account termination, while still fulfilling all accrued rights and obligations.

DATA WE COLLECT

We collect data to support our services. This data is collected when the User registers, uses the services, and/or communicates with us.

The types of data we collect to support our services are:

Company Identity Data: Company name, business type, number and copies of licensing documents (NIB, related Business License, etc.), Taxpayer Identification Number (NPWP), and office address.
Contact and Personal Data: Full name, position/title, email address, contact person phone number, and address.
Financial Data: Bank account information for Fee payment processing and/or transaction settlement.
Service-Related Data (Vessel Owner): Vessel details (name, size, capacity, type, flag, certification, operational permit documents).
Service-Related Data (Cargo Owner): Cargo details (type, volume, weight, port of loading/unloading, shipping date).
Technical Data: System logs, IP address, device, cookies/similar technologies.
Vessel Location/Tracking Data (If activated/available): AIS signal and other legitimate location data.
Payment Data: Payment method, proof of transaction.
Document Signing Legality Data:

Related to Electronic Signature and Electronic Stamp Duty: Data required to ensure the validity of the document and that the signing is performed legitimately.
Related to Wet Signature and Physical Stamp Duty: We store the documents or data that the User uploads to the Platform after being manually signed. This data is used to ensure that the contract document uploaded by the User is correct, complete, valid, and meets the requirements for Physical Stamp Duty.

LEGAL BASIS AND PURPOSE OF DATA PROCESSING

The Processing of Users' Personal Data and Company Data is carried out based on:
Explicit Consent: The User's consent upon registration and agreement to this Privacy Policy.
Fulfillment of Agreement: The performance of Our rights and obligations under the T&C.
Legal Obligation: Compliance with prevailing laws and regulations in Indonesia.
Our Purposes for processing User Data are:
facilitate and manage User accounts and the Services.
connect Vessel Owners and Cargo Owners, and to process transactions and Fees.
verify and validate the identity and documents of the Users.
provide customer support and respond to inquiries.
conduct marketing, promotion, and Service development activities (with prior consent).
comply with legal obligations, including reporting to the competent authorities.

SHARING DATA WITH THIRD PARTIES

We reserve the right to share the Personal Data of the Requester and/or Company Data (as applicable) with third parties to the extent necessary for the Platform's operations and the fulfillment of services. Such third parties include, but are not limited to:

Transaction and Support Partners: Payment/escrow providers, banks, financing institutions, insurance companies, Know Your Customer (KYC) or Know Your Business (KYB) service providers, tracking providers, and information technology infrastructure providers.
Key Business Partners: Cargo Owners, Vessel Owners, and/or authorized parties directly involved in the User's transactions on the Platform.
Government Authorities: Government authorities, law enforcement agencies, or regulatory bodies, in accordance with applicable legal obligations and provisions.

We also require all such third parties to comply with reasonable and relevant data security and confidentiality standards.

CROSS-BORDER DATA TRANSFER

Where the Processing or storage of Personal Data occurs outside the territory of the Republic of Indonesia, We will take the steps required by the applicable laws and regulations, including providing notification to the Requester if legally required.

DATA RETENTION

We will retain User Data for as long as necessary to fulfill the data processing purposes or for the duration required by the applicable laws and regulations, after which the data will be securely deleted or anonymized.

USER RIGHTS REGARDING DATA

The rights of the User are subject to the relevant laws and regulations applicable in Indonesia. The User shall have the right to:

Access and Copy of Data: The User may request access to and a copy of the data We process, which will be handled on a case-by-case basis. We may charge a processing fee and request additional verification for security reasons. Certain Data may be excluded due to legal or operational retention requirements.
Correction/Rectification of Data: The User has the right to request the rectification of inaccurate or incomplete data. We provide a [............] option on the Application/Website for updating most details. Rectification requests pertaining to Bookings made with the Vessel Owner will be subject to the respective Vessel Owner's policies.
Account and Data Deletion: The User may submit a request for Data deletion or account cancellation through the available features. The User acknowledges that certain data may remain stored for a specified period in accordance with legal obligations (taxation, financial, etc.) or Our operational needs. We will ensure that such data is destroyed or anonymized once these legal obligations cease.
Objection and Restriction: The User may submit a reasonable objection to the use of certain Data or request the restriction of its processing (e.g., when the Requester disputes the accuracy of the data). We will evaluate such objections, but the objection shall not apply if the processing is legally mandated or necessary to fulfill the contract with the User. While the restriction is in effect, We may be unable to provide certain Products and Services.
Withdrawal of Consent: The User may withdraw consent for the Data Processing at any time if such Processing is based on the User’s consent. Such withdrawal shall not affect the legality of the data Processing that has been carried out previously. The withdrawal of consent may hinder Our communication regarding offers and services.
Request Procedure: All requests pertaining to these rights will undergo an identity and authority screening and verification process of the User. We will review and process acceptable requests within the timeframe stipulated by the relevant law.
Submission of Complaints: If the User is dissatisfied with Our response to the complaint submitted, the User shall have the right to lodge a complaint with the competent local data protection authority.

DATA SECURITY

We are committed to consistently implementing Our best efforts to protect and secure User Personal Data from unlawful access, disclosure, or processing, as well as the risk of accidental loss or damage.

The User acknowledges that data transmission over the internet cannot be absolutely guaranteed to be secure. Therefore, We do not fully warrant that Personal Data will not be intercepted, accessed, or disclosed by unauthorized third parties due to factors beyond Our control.

If a Data protection failure occurs that has a significant impact on the User, We will notify the User and/or the relevant authorities in writing no later than 3x24 hours from the time such failure is known.

The User is fully responsible for maintaining the confidentiality of their account, including the password held. The User is obligated to secure the device used in the data input process and not to share account details with any party.

COOKIES & SIMILAR TECHNOLOGIES

We utilize cookies and/or Software Development Kits (SDKs) for the purposes of core Platform functionality, performance analytics, and enhancing User experience. Users can manage preferences regarding the use of these technologies through browser settings or the cookie preference center available on Our Platform (if applicable).

MINORS

The Services are not intended for individuals below the minimum age limit stipulated by the applicable laws and regulations. We will not knowingly collect the Personal Data of minors because this Application is specifically designed for Individuals and Legal Entities who possess the legal competence to act and/or make decisions.

AMENDMENTS TO THE PRIVACY POLICY

We reserve the right to amend or update this Privacy Policy at any time to reflect changes in Our practices or law. Notification of material changes will be announced through the Application. By continuously using the Application, the User is deemed to agree to the updated Privacy Policy.

PENDAHULUAN

PENGAKUAN DAN PERSETUJUAN

Persetujuan Utama: Dengan mencentang kotak persetujuan yang tersedia dan/atau dengan melanjutkan penggunaan platform ini, Pengguna secara eksplisit mengakui telah membaca, memahami, dan menyetujui seluruh ketentuan dalam Kebijakan Privasi kami dan secara tegas memberikan persetujuan kepada kami untuk memproses Data Pribadi dan Data Perusahaan sesuai dengan ketentuan tersebut.
Data Pihak Ketiga: Jika Pengguna menyediakan Data Pribadi yang berkaitan dengan individu lain (misalnya, staf, perwakilan kargo, atau mitra bisnis), Pengguna menyatakan dan menjamin telah memperoleh persetujuan yang sah dari individu tersebut untuk Pemrosesan Data Pribadi mereka oleh Kami. Kewajiban Kerahasiaan Data Pengguna Lain: Pengguna berjanji untuk hanya menggunakan Data Pribadi Pengguna atau Mitra lain yang diterima saat menggunakan Aplikasi semata-mata untuk tujuan penggunaan layanan. Pemesan bertanggung jawab penuh atas segala bentuk penyalahgunaan Data Pribadi yang dilakukan dan melepaskan Kami dari segala kewajiban terkait penyalahgunaan tersebut.
Penarikan Persetujuan: Pengguna dapat menarik persetujuan Pemrosesan Data Pribadi atau persetujuan untuk menerima komunikasi pemasaran kapan saja, dengan memberikan pemberitahuan tertulis yang wajar. Pengguna memahami dan mengakui bahwa penarikan persetujuan tersebut dapat mengakibatkan ketidakmampuan untuk menggunakan Aplikasi atau layanan Kami lebih lanjut, termasuk penghentian layanan atau pengakhiran akun, dengan tetap dipenuhinya semua hak dan kewajiban yang telah timbul.

DATA YANG KAMI KUMPULKAN

Kami mengumpulkan data-data untuk mendukung layanan kami, data ini dikumpulkan pada saat Pengguna mendaftar, menggunakan layanan dan / atau berkomunikasi dengan kami.

Jenis data yang kami kumpulkan untuk mendukung layanan kami:

Data Identitas Perusahaan: Nama perusahaan, jenis usaha, nomor dan salinan dokumen perizinan (NIB, Izin Usaha terkait dsb.), Nomor Pokok Wajib Pajak (NPWP), dan alamat kantor.
Data Kontak dan Pribadi: Nama lengkap, jabatan, alamat email, nomor telepon kontak person, dan salamat.
Data Keuangan: Informasi rekening bank untuk proses pembayaran Fee dan/atau penyelesaian transaksi.
Data Terkait Layanan (Pemilik Kapal): Detail kapal (nama, ukuran, kapasitas, jenis, bendera, sertifikasi, dokumen izin operasional).
Data Terkait Layanan (Pemilik Kargo): Detail kargo (jenis, volume, berat, pelabuhan muat/bongkar, tanggal pengiriman).
Data Teknis: log sistem, alamat IP, perangkat, cookies/teknologi serupa.
Data Lokasi/Tracking Kapal (Jika diaktifkan/tersedia): sinyal AIS dan data lokasi lain yang sah.
Data Pembayaran: metode pembayaran, bukti transaksi.
Data Legalitas Penandatanganan Dokumen:

Terkait Tanda Tangan Elektronik dan Meterai Elektronik: Data diperlukan untuk menjamin keabsahan dokumen dan penandatanganan dilakukan secara sah.
Terkait Tanda Tangan Basah dan Meterai Fisik: Kami menyimpan dokumen atau data yang Pengguna unggah ke Platform setelah ditandatangani secara manual. Data ini digunakan untuk memastikan dokumen kontrak yang Pengguna unggah sudah benar, utuh, sah dan memenuhi syarat Bea Meterai Fisik.

DASAR HUKUM DAN TUJUAN PEMROSESAN DATA

Pemrosesan Data Pribadi dan Data Perusahaan Pengguna dilakukan berdasarkan:
Persetujuan Eksplisit: Persetujuan Pengguna saat mendaftar dan menyetujui Kebijakan Privasi ini.
Pemenuhan Perjanjian: Pelaksanaan hak dan kewajiban Kami berdasarkan S&K.
Kewajiban Hukum: Kepatuhan terhadap peraturan perundang-undangan yang berlaku di Indonesia.
Tujuan Kami memproses Data Pengguna adalah:
Memfasilitasi dan mengelola akun Pengguna dan Layanan.
Mempertemukan Pemilik Kapal dan Pemilik Kargo, serta memproses transaksi dan Fee.
Melakukan verifikasi dan validasi identitas dan dokumen Pengguna.
Menyediakan dukungan pelanggan dan menanggapi pertanyaan.
Melakukan kegiatan pemasaran, promosi, dan pengembangan Layanan (dengan persetujuan).
Mematuhi kewajiban hukum, termasuk pelaporan kepada otoritas yang berwenang.

BERBAGI DATA DENGAN PIHAK KETIGA

Kami berhak membagikan Data Pribadi Pemesan dan/atau Data Perusahaan (sebagaimana berlaku) dengan pihak ketiga sejauh diperlukan untuk operasional Platform dan pemenuhan layanan. Pihak ketiga tersebut termasuk, namun tidak terbatas pada:

Mitra Transaksi dan Pendukung: Penyedia pembayaran/escrow, bank, lembaga pembiayaan, perusahaan asuransi, penyedia layanan Know Your Customer (KYC) atau Know Your Business (KYB), penyedia pelacakan (tracking), dan penyedia infrastruktur teknologi informasi.
Mitra Bisnis Utama: Pemilik Kargo, Pemilik Kapal, dan/atau pihak yang diberi kuasa yang terlibat langsung dalam transaksi Pengguna di Platform.
Otoritas Pemerintah: Otoritas pemerintah, penegak hukum, atau badan regulator, sesuai dengan kewajiban dan ketentuan hukum yang berlaku.

Kami juga mewajibkan semua pihak ketiga tersebut untuk mematuhi standar keamanan dan kerahasiaan data yang wajar dan relevan.

TRANSFER DATA LINTAS NEGARA

Apabila Pemrosesan atau penyimpanan Data Pribadi terjadi di luar wilayah Republik Indonesia, Kami akan mengambil langkah-langkah yang diwajibkan oleh peraturan perundang-undangan yang berlaku, termasuk memberikan pemberitahuan kepada Pemesan jika diwajibkan secara hukum.

RETENSI DATA

Kami akan menyimpan Data Pengguna selama diperlukan untuk memenuhi tujuan pemrosesan data atau selama jangka waktu yang dipersyaratkan oleh peraturan perundang-undangan yang berlaku, setelah mana data tersebut akan dihapus atau dianonimkan secara aman.

HAK-HAK PENGGUNA TERHADAP DATA

Hak-hak Pengguna disesuaikan dengan ketentuan hukum dan peraturan terkait yang berlaku di Indonesia, Pengguna memiliki hak-hak untuk:

Akses dan Salinan Data: Pengguna meminta akses dan salinan data yang Kami proses, yang akan ditangani berdasarkan kasus per kasus. Kami dapat mengenakan biaya pemrosesan dan meminta verifikasi tambahan untuk alasan keamanan. Data tertentu dapat dikecualikan karena persyaratan penyimpanan hukum atau operasional.
Koreksi/Perbaikan Data: Pengguna berhak meminta perbaikan data yang tidak akurat atau tidak lengkap. Kami menyediakan opsi …………………. di Aplikasi/Situs untuk pembaruan sebagian besar detail. Permintaan perbaikan yang berkaitan dengan Pemesanan yang dilakukan dengan Pemilik Kapal akan tunduk pada kebijakan Pemilik Kapal tersebut.
Penghapusan Akun dan Data: Pengguna dapat mengajukan permintaan penghapusan Data atau pembatalan akun melalui fitur yang tersedia. Pengguna mengakui bahwa data tertentu mungkin tetap disimpan untuk jangka waktu tertentu sesuai dengan kewajiban hukum (perpajakan, keuangan, dll) atau operasional kami. Kami akan memastikan data tersebut dimusnahkan atau dianonimkan setelah kewajiban hukum tersebut berakhir.
Keberatan dan Pembatasan: Pengguna dapat mengajukan keberatan yang beralasan atas penggunaan Data tertentu atau meminta pembatasan pemrosesannya (misalnya, saat Pemesan mempermasalahkan keakuratan data). Kami akan mengevaluasi keberatan tersebut, namun keberatan tidak berlaku jika pemrosesan diwajibkan secara hukum atau diperlukan untuk memenuhi kontrak dengan Pengguna. Selama pembatasan berlaku, Kami mungkin tidak dapat menyediakan Produk dan Layanan tertentu.
Penarikan Persetujuan: Pengguna dapat menarik persetujuan atas Pemrosesan Data kapan saja jika Pemrosesan tersebut didasarkan pada persetujuan Pengguna. Penarikan tersebut tidak mempengaruhi keabsahan Pemrosesan data yang telah dilakukan sebelumnya. Penarikan persetujuan dapat menghambat komunikasi Kami mengenai penawaran dan layanan.
Prosedur Permintaan: Semua permintaan yang berkaitan dengan hak-hak ini akan melalui proses penyaringan dan verifikasi identitas serta kewenangan Pengguna. Kami akan meninjau dan memproses permintaan yang dapat diterima dalam jangka waktu yang ditentukan oleh hukum terkait.
Pengajuan Keluhan: Jika Pengguna tidak puas dengan tanggapan Kami terhadap keluhan yang diajukan, Pengguna berhak mengajukan keluhan kepada otoritas perlindungan data setempat yang berwenang.

KEAMANAN DATA

Kami berkomitmen untuk selalu menerapkan upaya terbaik kami untuk melindungi dan mengamankan Data Pribadi Pengguna dari akses, pengungkapan, pemrosesan yang melanggar hukum, serta resiko kehilangan atau kerusakan yang tidak disengaja.

Pengguna mengakui bahwa transmisi data melalui internet tidak dapat dijamin keamanannya secara mutlak. Oleh karena itu, kami tidak menjamin sepenuhnya bahwa data Pribadi tidak akan dicegat, diakses, atau diungkapkan oleh pihak ketiga yang berwenang akibat factor di luar kendali Kami.

Jika terjadi kegagalan perlindungan Data yang berdampak signifikan pada Pengguna, kami akan memberitahukan hal tersebut secara tertulis kepada Pengguna dan/atau otoritas terkait selambat-lambatnya 3x24 jam sejak hal tersebut diketahui.

Pengguna bertanggung jawab penuh untuk menjaga kerahasiaan akunnya, termasuk pada kata sandi yang dimiliki. Penggunan wajib menjadi keamanan perangkat yang digunakan dalam proses input data dan tidak membagikan detail akun kepada pihak manapun.

COOKIES & TEKNOLOGI SERUPA

Kami menggunakan cookies dan/atau Software Development Kit (SDK) untuk tujuan fungsionalitas inti Platform, analitik kinerja, dan peningkatan pengalaman Pengguna. Pengguna dapat mengelola preferensi terkait penggunaan teknologi ini melalui pengaturan browser atau pusat preferensi cookies yang tersedia di Platform Kami (jika ada).

PENGGUNA DI BAWAH UMUR

Layanan ini tidak ditujukan untuk individu yang berada di bawah batas usia minimum yang ditentukan oleh peraturan perundang-undangan yang berlaku. Kami tidak akan secara sengaja mengumpulkan Data Pribadi individu di bawah umur dikarenakan Aplikasi ini memang dirancang untuk Perorangan maupun Badan Hukum yang tentunya sudah memiliki Kecakapan dalam bertindak dan / atau memutuskan sesuatu.

PERUBAHAN KEBIJAKAN PRIVASI

Kami berhak untuk mengubah atau memperbarui Kebijakan Privasi ini sewaktu-waktu untuk mencerminkan perubahan dalam praktik atau hukum Kami. Pemberitahuan mengenai perubahan material akan diumumkan melalui Aplikasi. Dengan terus menggunakan Aplikasi, Pengguna dianggap menyetujui Kebijakan Privasi yang telah diperbarui.

HUKUM YANG BERLAKU

Kebijakan Privasi ini diatur dan ditafsirkan sesuai dengan hukum yang berlaku di Republik Indonesia, khususnya Undang-Undang Nomor 27 Tahun 2022 tentang Perlindungan Data Pribadi (UU PDP) dan peraturan perundang-undangan terkait lainnya. Pengguna dan Platform setuju untuk tunduk pada yurisdiksi pengadilan di Indonesia untuk setiap sengketa yang mungkin timbul dari atau sehubungan dengan Kebijakan Privasi ini.
